    أنواع الشركات في الاردن

    1. شركة التضامن
    • تتألف من أشخاص طبيعيين لا يقل عن عددهم عن اثنين ولا يزيد عن عشرين شريكاً.
    • رأس المال: لا يشترط حد أدنى لرأس مال الشركة (باستثناء أي شروط حسب قطاع عمل الشركة).
    • يجب أن يكون الشريك قد أتم الثامنة عشرة من عمره على الأقل.
    • يكتسب كل شريك فيها صفة تاجر.
    • عنوان الشركة (اسمها – "شركة محمد محمود وأولاده" مثلاً) يجب أن يكون مستمداً من أسماء جميع الشركاء فيها، أو من لقب وكنية كل منهم، أو من اسم واحد أو أكثر منهم مع اضافة عبارة (وشركاه أو شركاهم). بالاضافة الى أن لشركة التضامن أن تتخذ اسماً تجارياً على أن يقترن بالعنوان الذي سجلت به الشركة (مثل "مكتبة العلم – شركة محمد محمود وأولاده").
    2. شركة التوصية البسيطة
    • تتألف من فئتين من الشركاء كالتالي:
      • الشركاء المتضامنون – وهم الذين يتولون ادارة الشركة وممارسة أعمالها، ويكونون مسؤولون في أموالهم الخاصة وبالتضامن والتكافل عن ديون الشركة والالتزامات المترتبة عليها.
      • الشركاء الموصون – وهم الذين يشاركون في رأس مال الشركة دون أن يحق لهم ادارة الشركة أو ممارسة أعمالها، ويكون كل منهم مسؤولاً عن ديون الشركة والالتزامات المترتبة عليها بمقدار حصته في رأس مال الشركة فقط.
    • رأس المال: لا يشترط حد أدنى لرأس مال الشركة (باستثناء أي شروط حسب قطاع عمل الشركة).
    • عنوان الشركة (اسمها – "شركة حسن عمر وشركاه" مثلاً) يجب أن يكون مستمداً من أسماء الشركاء المتضامنين، مع اضافة عبارة "وشركاه" للاشارة الى الشركاء الموصين، ولا يجوز ادراج اسم الشريك الموصي في عنوان الشركة. كما أنه يمكن لشركة التوصية البسيطة أن تتخذ اسم تجاري (كما هو الحال بالنسبة لشركة التضامن).
    3. الشركة ذات المسؤولية المحدودة
    • تتألف من شخصين أو أكثر، الا أنه يجوز لمراقب الشركات الموافقة على تسجيل شركة ذات مسؤولية محدودة تتألف من شخص واحد.
    • يمكن أن يكون الشركاء فيها من الأشخاص المعنويين.
    • رأس المال: الحد الأدنى لرأس مال الشركة ذات المسؤولية المحدودة هو دينار أردني واحد، وقد كان في السابق ثلاثون ألف دينار، ثم أصبح ألف دينار الى أن أصبح حالياً دينار أردني واحد فقط. وكما هو الحال في الشركات الأخرى، يجب مراعاة أي رأس مال أعلى تشترط حسب قطاع عمل الشركة.
    • الذمة المالية المستقلة للشركة والمسؤولية المحدودة للشركاء: أهم ما يميز هذه الشركة عن شركة التضامن هو أن الذمة المالية للشركة تعتبر مستقلة عن الذمة المالية لكل شريك فيها وتكون الشركة بموجوداتها وأموالها مسؤولة عن الديون والالتزامات المترتبة عليها، ولا يكون الشريك مسؤولاً عن تلك الديون والالتزامات والخسائر الا بمقدار حصصه التي يمتلكها في الشركة.
    • اسم الشركة ("شركة نور الأردن للتعليم القانوني المستمر ذ.م.م." مثلاً) يجب أن يكون مستمداً من غاياتها وأن تضاف اليها عبارة "ذات المسؤولية المحدودة" أو الأحرف "ذ.م.م".
    • يجب أن يدرج اسم الشركة ومقدار رأسمالها ورقم تسجيلها في جميع الأوراق والمطبوعات التي تستخدمها في أعمالها وفي العقود التي تبرمها.
    4. شركة التوصية بالأسهم
    تتألف شركة التوصية بالأسهم من فئتين من الشركاء كالتالي:
    الشركاء المتضامنون – ويجب أن لا يقل عددهم عن اثنين، ويكونون مسؤولون في أموالهم الخاصة عن ديون الشركة والالتزامات المترتبة عليها.
    الشركاء المساهمون – ويجب أن لا يقل عددهم عن ثلاثة، ويكون كل منهم مسؤولاً عن ديون الشركة والالتزامات المترتبة عليها بمقدار مساهمته في الشركة فقط.
    رأس المال: الحد الأدنى لرأس المال في شركة التوصية بالأسهم هو (100،000) مائة ألف دينار أردني مقسمة الى أسهم قابلة للتداول.
    يشترط أن لا يزيد رأس مال الشركة الذي يطرح للاكتتاب على مثلي مجموع مساهمة الشركاء المتضامنون.
    هذا النوع من الشركات غير مستعمل فعلياً في الأردن، لتعقيد أحكامها وارتفاع رأسمالها.

    5. الشركات المساهمة الخاصة
    تتألف الشركة المساهمة الخاصة من شخصين أو أكثر، على أنه يجوز لوزير الصناعة والتجارة بناء على تنسيب مبرر من مراقب الشركات أن يوافق على تسجيل شركة مساهمة خاصة مؤلفة من شخص واحد.
    الذمة المالية للشركة مستقلة ومسؤولية المساهمين محدودة بمقدار مساهمتهم برأس مال الشركة..
    اسم الشركة ("أمنية للصناعات الدوائية شركة مساهمة خاصة محدودة" مثلاً) يجب أن لا يتعارض مع غاياتها وأن تتبعه عبارة "شركة مساهمة خاصة محدودة".
    رأس المال: يجب أن لا يقل رأس المال المكتتب به للشركة عن (50،000) خمسين ألف دينار أردني.


    6. الشركات المساهمة العامة
    • تتألف الشركة المساهمة العامة من عدد من المؤسسين لا يقل عن اثنين يكتتبون فيها بأسهم قابلة للادراج والتداول والتحويل في أسواق الأوراق المالية، على أنه يجوز لوزير الصناعة والتجارة بناء على تنسيب مبرر من مراقب الشركات أن يوافق على أن يكون مؤسس الشركة المساهمة العامة شخص واحد.
    • الذمة المالية للشركة مستقلة ومسؤولية المساهمين محدودة بمقدار مساهمتهم برأس مال الشركة.
    • اسم الشركة المساهمة العامة ("شركة البنك الأهلي الأردني شركة مساهمة عامة محدودة" مثلاُ) يجب أن يكون مستمداً من غايتها ويجب أن تتبعه عبارة "شركة مساهمة عامة محدودة".
    • رأس المال: يجب أن لا يقل رأسٍ المال المصرح به للشركة المساهمة العامة عن (500،000) خمسمائة ألف دينار، وأن لا يقل رأس المال المكتتب به عن (100،000) مئة ألف دينار أو (20%) عشرين بالمئة من رأس المال المصرح به أيهما أكثر.
    • هناك أنواع معينة من الأعمال لا يمكن القيام بها الا من قبل شركات مساهمة عامة، مثل أعمال البنوك والشركات المالية والتأمين، والشركات ذات الامتياز.
    • عقد التأسيس والنظام الأساسي: عند تسجيل الشركة المساهمة العامة يجب أن يقدم طلب التسجيل الى مراقب الشركات مرفقاً به عقد تأسيس الشركة ونظامها الأساسي، وينص قانون الشركات على البيانات التي يجب أن ترد في العقد التأسيس وتلك الواجبة الورود في النظام الأساسي للشركة.     • تخضع الشركات المساهمة العامة لرقابة شديدة من العديد من الجهات المختصة مثل: مراقب الشركات، هيئة الأوراق المالية، هيئة مكافحة الفساد، البنك المركزي (للبنوك والشركات المالية)، هيئة تنظيم قطاع التأمين...الخ.
    • مدققو الحسابات والمحامون: تلتزم الشركة المساهمة العامة باختيار مدقق حسابات قانوني (محاسب قانوني مسجل لدى جمعية المحاسبين القانونيين الأردنيين) لغايات تدقيق حساباتها. كما تلتزم بتعيين وكيلاً أو مستشاراً قانونياً.

      How many types of companies are there in the UK?


      There are 8 types of companies in the UK: public limited company (PLC); private company limited by shares (LTD); company limited by guarantee; unlimited company (UNLTD); Limited Liability Partnership (LLP); Community Interest Company; Industrial and Provident Society (IPS) and finally, Royal Charter (RC).

      The distinction between the different types has important ramifications for the legal status of the company, particularly with regards to ownership and what happens if the company goes into liquidation.

      Public limited company (PLC)


      A public company is a corporation whose ownership is open to the public. Anyone can buy shares in the company’s stocks.

      A limited company is a corporation in which an individual’s financial liability for the company is restricted to a fixed sum - this sum is usually the value of their investment.

      A PLC is a combination of these two concepts - it is a public company whose shareholders (who could, theoretically, be anyone) are responsible for the company’s financial liabilities to the extent of their investment.

      The other key point of note is that before a PLC can start business, it must have allotted shares to the total value of at least £50,000.
      Private company limited by shares (LTD)


      In contrast to a public company, a private company cannot be owned by any members of the public. It will instead be owned by an NGO (non-government organisation) or a relatively small number of shareholders, and the sale of company shares is handled privately.

      Company limited by guarantee


      A company that is limited by guarantee is very different to the two previous types of limited company. In this case, the individuals are not responsible for a fixed sum based on their investment, as this company status is reserved for companies that don’t have shareholders, like smaller, non-profit organisations.

      Instead of shareholders, these companies typically have a group of members who act as guarantors and agree to contribute a nominal sum towards the winding up of the company, in the case of such an event occurring.

      According to UK law, these companies have to include ‘Limited’ in their names, but exceptions can be made, for example, in the case of companies that are not distributing their profits to its members.
      Unlimited company (Unltd)


      The key difference between limited and unlimited companies is that there is no formal restriction on the amount of money that shareholders have to pay if a company goes into formal liquidation.

      In the event of a formal liquidation (and only then), the shareholders are responsible for completely settling the company’s outstanding financial liabilities, regardless of the extent of their investment in the company.
      Limited liability partnership (LLP)


      The first thing to note about LLPs is that they are not legally treated as partnerships in the UK, instead, they are treated as incorporated bodies that are more similar to the other types of company looked at in this post.

      For a business to be an LLP, some or all of the partners have to have limited liabilities, which means that they are only responsible for their own misconduct or negligence, rather than being responsible as a collective (which is the more traditional partnership model).
      Community interest company


      This is a status that was created for companies that are not driven by the objective of maximising profits for their shareholders, but with the intention of using their assets and profits for the good of the communities that they’re in.

      These companies are made to be easy to set up, and they run on the basis that any money they make is not distributed to shareholders, but goes to improving the area around them.

      Many community interest companies will still put profits back into the company, but that will be done with the intention of improving the community services that they offer.
      Industrial and provident society (IPS)


      Industrial and provident societies are worth a mention, as they were a major company type for many years.

      Since 2014 they have been replaced everywhere in the UK, except Northern Ireland, by newer types like the community interest companies mentioned above, and by other names, such as cooperatives and community benefit societies.
      Royal charter (RC)


      If a company or organisation has been created by Royal Charter, it means that it has been granted power or a right by the monarch. Once upon a time, all companies had to be approved by Royal Charter, but those days are long gone, and other methods of starting a company have become far more prevalent.

      Notable examples of chartered organisations include the BBC, the Bank of England and the Royal Opera House. It’s worth knowing that chartered companies exist, but it’s unlikely that this type of company will have much bearing on your day to day business.

          by a decision from the minister or by a decision of the minister ?
          i found that both are correct but the concordance with of is more than from.

          Employment of young persons in heavy work, hazardous industries or socially dangerous jobs, as specified by decision of the Minister

          Employment of a young person on overtime or night work except where authorized by decision of the Minister

          The Minister will determine the amount of the allowance to be paid (depending on the severity of the condition affecting the person concerned) after obtaining approval from the Ministry of Finance.

            “الأردنيون أمام القانون سواء لا تمييز بينهم في الحقوق والواجبات”

            المادة 4
            يحق لكل عربي يقيم عادة في المملكة الاردنية الهاشمية مدة لا تقل عن خمس عشرة سنة متتالية ان يحصل على الجنسية الاردنية بقرار من مجلس الوزراء بناء على تنسيب وزير الداخلية اذا تخلى عن جنسيته الاصلية باقرار خطي وكانت قوانين بلاده تجيز له ذلك وبشرط :
            1. ان يكون حسن السيرة والسلوك وغير محكوم باية جريمة ماسة بالشرف والاخلاق.
            2. ان يكون له وسيلة مشروعة للكسب.
            3. ان يكون سليم العقل غير مصاب بعاهة تجعله عالة على المجتمع.
            4. ان يقسم يمين الولاء والاخلاص لجلالة الملك امام قاضي الصلح.
            – هكذا اصبحت هذه المادة بعد اضافة عبارة ( بقرار من مجلس الوزراء بناء على تنسيب وزير الداخلية ) اليها بعد عبارة ( ان يحصل على الجنسية الاردنية ) الواردة فيها بموجب القانون المعدل رقم 22 لسنة 1987 وكان قد تم الغاء نصها السابق والاستعاضة عنه بالنص الحالي بموجب القانون المعدل رقم 7 لسنة 1963 حيث كان نصها السابق كما يلي : يحق لكل عربي يقيم عند صدور هذا القانون في المملكة الاردنية الهاشمية ومضى على اقامته فيها مدة لا تقل عن الخمس عشرة سنة متتالية ان يحصل
            على الجنسية الاردنية ، اذا تخلى عن جنسيته الاصلية وكانت قوانين بلاده تجيز تخليه عنها

            المادة 9


            “لا يجوز الإتفاق على التحكيم إلا للشخص الطبيعي أو الإعتباري الذي يملك التصرف في حقوقه، ولا يجوز التحكيم في المسائل التي لا يجوز فيها الصلح, إذ أجازت المادة اللجوء إلى التحكيم في المسائل التي يجوز فيها الصلح.


            المادة ( 10/2)

            .جلسات المحاكم علنية إلا إذا رات المحاكم أن تكون سرية، مراعاة للنظام العام أو المحافظة على الأداب

            بعد أن يودع المدعي العام إضبارة الدعوى إلى المحكمة، على رئيس المحكمة أو من ينوب عنه من قضاة المحكمة في الجرائم التي يعاقب عليها بالإعدام أو الأشغال الشاقة المؤبدة، أو الإعتقال المؤبد ، أن يحضر المتهم ويسأله إن إختار محاميًا للدفاع عنه، فإن لم يكن قد فعل وكانت حالته المادية لا تساعده على إقامة محام ، عين له الرئيس أو نائبه محاميًا.

              Any Arab who normally resides in the Hashemite Kingdom of Jordan for at least 15 consecutive years shall be entitled to Jordanian citizenship by decision of the Council of Ministers on the basis of the placement of the Minister of the Interior if he or she renounces his or her original nationality on the basis of a written declaration and with conditions:

              1. To be of good character and conduct and not to be condemned to any serious crime of honour and morality.
              2. Having a legitimate means of earning.
              3. Being sane doesn't have a disability that makes him dependent on society.

              4. Swear the oath of allegiance and devotion to His Majesty the King to the Justice of the Peace.

              This article was thus introduced after the addition of the words "by decision of the Council of Ministers on the basis of the placement of the Minister of the Interior)." After Jordanian citizenship Contained in it under the amended law No. 22 of 1987, the previous text of which had been repealed and replaced by the current text by the amended law No. 7 of 1963, which had previously read as follows:

              Any Arab who has resided in the Hashemite Kingdom of Jordan for at least 15 consecutive years at the time of the adoption of this law shall be entitled to receive the Jordanian nationality, if he renounces his original nationality and his country's laws permit him to renounce it.

              Article 9

              Arbitration may be agreed only on the part of the natural or legal person who has the right to dispose of his or her rights, and on matters in which the magistrate may not be settled, the article permits arbitration in matters in which the magistrate may be settled.

In the event that the accused has not appointed a lawyer owing to the fact that his financial position does not help him to appoint a lawyer, the President or his deputy shall appoint him a lawyer.

                If we do not reply the X’s letter by the deadline, he will consider us to have lost interest in the transaction and that we have withdrawn the application.

                  1- المادة الأولى في القانون الأسري السعودي: «الاحترام المتبادل» بين جميع أفراد الأسرة لا فرق بين كبير أو صغير رجل أو امرأة, أب أو أم، ابن أو ابنة, أو أخ أو أخت... إلخ.

                  2- المادة الثانية في القانون الأسري السعودي: «الحوار الأسري», أن تخصص الأسرة لها وقتاً لمناقشة أي مشكلة أو صعوبة تعترض أحدهم أو جميعهم.

                  3- المادة الثالثة في القانون الأسري السعودي: «وقتاً للعب والتسلية» وهذا الوقت تخصصه الأسرة (الأب والأم) للعب والتسلية مع أبنائهما وبناتهما ومشاركتهم مرحهم ولهوهم وسعادتهم.

                  4- المادة الرابعة في القانون الأسري السعودي: «التشجيع والمكافأة», ومن خلال هذه المادة تحاول الأسرة أن تبذل أقصى إمكانياتها الفكرية والمالية لتشجيع جميع أفراد الأسرة في أي نشاط أو إنجاز أو مشروع يقدمون عليه, وأن يقدموا استحسانهم المعنوي ومكافآتهم المادية لهذا النشاط أو الإنجاز أو المشروع. وهذا التشجيع يساعد على النجاح المستمر والتشجيع أيضاً يساعد الأبناء والبنات على بناء ثقتهم بأنفسهم ويرفع من مفاهيمهم عنها ويعلمهم القيم والأخلاق المطلوبة.

                  5- المادة الخامسة والأخيرة من القانون الأسري السعودي: «إيصال ونشر الحب» بين جميع أفراد الأسرة. وهنا تتركز وتبنى فنون المشاعر الأبوية (الأب والأم) والتي تساعد أبناءهما وبناتهما على الشعور بالأمن وعدم الخوف والشعور بالاستقرار الفكري والجسدي والعاطفي, وبالتالي تجعلهم جميعاً سعداء في حياتهم, لأن الخوف يخلق في نفوس الأبناء والبنات الرعب ويدفعهم لأن يحصلوا على الحنان والحب من أفراد خارج إطارهم الأسري, لذلك يدعوهم القانون إلى (حب أبنائهما) لكي يبادلوهم الحب.

                  المادة 1

                  التسمية وبدء العمل

                  يسمى هذا القانون (قانون التنفيذ لسنة 2007) ويعمل به بعد ستين يوما من تاريخ نشره في الجريدة الرسمية .

                  المادة 2

                  إدارة التنفيذ

                  أ . يتم تنفيذ السندات التنفيذية المنصوص عليها في هذا القانون من قبل دائرة تسمى (دائرة التنفيذ) لدى كل محكمة بداية يرأسها قاض يسمى رئيس التنفيذ لا تقل درجته عن الرابعة ويعاونه قاض او اكثر يقوم اقدمهم مقامه عند غيابه .
                  ب. يقصد بكلمة (الدائرة) و(الرئيس) و(المأمور) حيثما وردت في هذا القانون (دائرة التنفيذ) و(رئيس التنفيذ) و(مأمور التنفيذ) حسب مقتضى الحال .

                  المادة 3

                  إدارة التنفيذ

                  أ . يباشر قاضي الصلح اختصاصات الرئيس في الاماكن التي ليس فيها محكمة بداية .

                  ب. يباشر المأمور اجراءات التنفيذ يعاونه عدد كاف من الكتبة والمحضرين .
                  ج. لا يجوز القيام بأي اجراء تنفيذي قبل الساعة السابعة صباحا او بعد السابعة مساء الا في حالات الضرورة وباذن من الرئيس .

                  المادة 4

                  الاختصاص

                  أ . دائرة التنفيذ المختصة هي الدائرة التي توجد في منطقة المحكمة التي اصدرت الحكم أو موطن المحكوم عليه او محكمة موطن المحكوم له او الدائرة التي تم انشاء السندات التنفيذية في منطقتها .

                  ب. يجوز التنفيذ في الدائرة التي يكون موطن المدين او امواله فيها او الدائرة التي اشترط الوفاء في منطقتها.

                  ج. اذا اقتضى التنفيذ اتخاذ تدابير خارج منطقة الدائرة فللرئيس إنابة الدائرة التي ستتخذ فيها التدابير التنفيذية .

                  د. إذا تعددت الدوائر المختصة بتنفيذ السند التنفيذي الواحد فينعقد الاختصاص للدائرة التي قدم إليها الطلب أولا.

                  المادة 5الاختصاص

                  أ . يختص الرئيس او من يقوم مقامه بجميع المنازعات التنفيذية بما في ذلك القاء الحجز على اموال المدين وفك الحجز وبيع الاموال المحجوزة وتعيين الخبراء وحبس المدين ومنعه من السفر والتفويض باستعمال القوة الجبرية .

                  ب. للرئيس او من يقوم مقامه الاشراف على جميع اعمال الدائرة والعاملين فيها ويرجعون اليه في اعمالهم ويلتزمون بتوجيهاته .
                  ج. يختص المأمور بمباشرة الاجراءات التي يقتضيها تنفيذ السندات التنفيذية وتنفيذ قرارات الرئيس واوامره .
                  د . يختص الكتبة بتنظيم اوراق الدائرة ومحاضرها وسائر ما يعهد به اليهم الرئيس او المأمور .
                  هـ. يختص المحضرون بتبليغ الاوراق المتعلقة بالتنفيذ والالتزام بتنفيذ اوامر الرئيس او المأمور .
                  و. يعطي الرئيس او من يقوم مقامه امر خطيا للمأمور والكتبة والمحضرين يخولهم فيه حق مراجعة الشرطة لتمكينهم من القيام بما يعهد اليهم به من وظائف تنفيذية ، ويجب على كل من يبرز اليه هذا الامر الخطي ان يساعدهم على القيام بوظائفهم تحت طائلة المسؤولية .

                  المادة 6السند التنفيذي

                  لا يجوز التنفيذ الا بسند تنفيذي اقتضاء لحق محقق الوجود ومعين المقدار وحال الاداء ، وتشمل السندات التنفيذية ما يلي :

                  أ . الاحكام الصادرة عن المحاكم الحقوقية والشرعية والدينية واحكام المحاكم الجزائية المتعلقة بالحقوق الشخصية والأحكام الإدارية المتعلقة بالالتزامات الشخصية والاحكام والقرارات الصادرة عن اي محكمة او مجلس او سلطة اخرى نصت قوانينها الخاصة على ان تتولى الدائرة تنفيذها واي احكام اجنبية واجبة التنفيذ بمقتضى اي اتفاقية .

                  ب. السندات الرسمية.

                  ج. السندات العادية والأوراق التجارية القابلة للتداول.

                  المادة 7السند التنفيذي ( )

                  أ- يراعى في تنفيذ السندات المنصوص عليها في الفقرتين (ب) و(ج) من المادة (6) من هذا القانون ما يلي:-

                  1- للمدين بعد تبليغه الإخطار بالدفع أن يعترض على مجموع الدّين أو على قسم منه خلال خمسة عشر يوماً تلي تاريخ التبليغ.

                  2- يثابر على التنفيذ إذا لم يقدم الاعتراض في الموعد المحدد.

                  3- إذا أقر المدين بالدّين أو بقسم منه، فيدون ذلك في محضر التنفيذ، وتقوم الدائرة بتنفيذ ما جرى الإقرار به.

                  4- إذا اعترض المدين على الدّين، كله أو قسم منه، وثبت عدم صحة هذا الاعتراض أمام المحكمة المختصة، تقضي المحكمة بالزام المدين بغرامة تعادل خمس قيمة الدّين المنازع به تدفع كلها للخزينة، ويثابر على التنفيذ من النقطة التي تم الوصول إليها.

                  5- في جميع الأحوال، إذا استوفى الدائن دينه، كله أو بعضه، وفق الإجراءات المنصوص عليها في هذه المادة، فيبقى للمدين الحق باقامة دعوى موضوعية لاسترداد ما استوفي منه بغير حق.

                  ب- إضافة إلى ما ورد في الفقرة (أ) من هذه المادة يراعى في تنفيذ السندات المنصوص عليها في الفقرة (ب) من المادة (6) من هذا القانون ما يلي:-

                  1- يجوز للدائن أن يطلب من الدائرة تحصيل دينه من الكفلاء.

                  2- يكون اعتراض المدين على الدّين إما بادعاء تزوير السند الرسمي أو الادعاء بالوفاء كلياً أو جزئياً، و على المدين مراجعة المحكمة المختصة لإثبات صحة ادعائه، ولا توقف معاملة التنفيذ إلا إذا أصدرت المحكمة المختصة قرارا بوقفها في حدود ما تم الاعتراض عليه.

                  ج- إضافة إلى ما ورد في الفقرة (أ) من هذه المادة، يراعى في تنفيذ السندات المنصوص عليها في الفقرة (ج) من المادة (6) من هذا القانون ما يلي:-

                  1- يجوز للدائن أن يطلب من الدائرة تحصيل دينه من المظهرين والكفلاء.

                  2- يكون اعتراض المدين على الدين اما بانكار التوقيع أو بالادعاء بالتزوير أو بالادعاء بالوفاء كلياً أو جزئياً.

                  3- في حالة إنكار التوقيع أو الادعاء بالتزوير، توقف معاملة التنفيذ، ويكلف الدائن بمراجعة المحكمة المختصة لإثبات ما وقع عليه الإنكار أو الادعاء بالتزوير.

                  4 – في حالة الادعاء بالوفاء كلياً أو جزئياً، فعلى المدين مراجعة المحكمة المختصة لإثبات الوفاء، ولا توقف معاملة التنفيذ إلا إذا أصدرت المحكمة المختصة قراراً بوقفها في حدود ما تم الاعتراض عليه.

                    Article 1

                    Naming and starting work

                    This law (Implementation law 2007) is called and shall be in force 60 days after its publication in the Official Gazette.
                    article
                    A. The executive bonds provided for in this law shall be executed by a chamber called the Enforcement Chamber in each Court of First Instance, which shall be presided over by a judge called the Chief of Enforcement at least four degrees and shall be assisted by one or more judges, the oldest of whom shall act in his or her place in his or her absence.
                    B. "Service," "Chief" and "Sheriff" shall mean where they appear in this law (Enforcement Service), "Chief of Execution" and "Chief of Enforcement" as the case appropriate.

                    Article 3

                    Implementation management

                    A. The Magistrate shall exercise the powers of the President in places where there is no court of first instance.

                    B. The Sheriff begins enforcement proceedings with a sufficient number of clerks and notaries.
                    C. No executive action shall be undertaken before 7 a.m. or after 7 p.m. except in cases of necessity and with the permission of the President.

                    Jurisdiction

                    A. A competent enforcement chamber is a chamber located in the area of the sentencing court, the home of the sentenced person, the home court of the sentenced person or the chamber in whose area executive bonds have been established.

                    B. Performance may be performed in the service in which the debtor is home or in which its funds are located or in whose area the performance is required.

                    C. If implementation requires measures to be taken outside the area of the Chamber, the President shall order the Chamber in which the executive measures shall be taken.

                    D. If the competent authorities are multiple in implementing the single executive document, the Chamber to which the request was first made shall have jurisdiction.

                    Article 5

                    Jurisdiction

                    A. All executive disputes, including the seizure of the debtor's funds, the removal of the debtor's funds, the sale of the funds seized, the appointment of experts, the confinement of the debtor, the prohibition of travel and the authorization of the use of force majeure, shall be vested in the President or his person in his place.

                    B. The President or his or her person may supervise all the work of the Chamber and its staff, refer to him or her in their work and abide by his or her directives.

                    C. The Sheriff is competent to initiate the procedures required for the execution of executive bonds and the execution of the decisions and orders of the President.

                    D. Clerks are competent to regulate the Chamber's papers, records and other matters entrusted to them by the President or the Sheriff.

                    H. The notaries are competent to communicate the papers on execution and the obligation to execute the orders of the chief or sheriff.

                    And... The President or his agent shall give a written order to the sheriff, clerks and notaries in which they shall have the right to review the police to enable them to perform the executive functions entrusted to them. Any person to whom such written order appears shall assist them in carrying out their functions under liability.


                    Article 6

                    Executive authority

                    Performance may only be performed by means of an executive document requiring the right of the confirmed existence to be specified in the amount and condition of performance.

                    A. Decisions of the courts of law, legality and religion, judgements of the criminal courts on personal rights, administrative judgements on personal obligations and judgements and decisions of any court, council or other authority whose own laws provide for their implementation by the Chamber and any foreign provisions that shall be enforced under any convention.

                    B. Official bonds.

                    C. Ordinary bonds and negotiable commercial papers.

                    Article 7

                    Executive authority

                    The implementation of the bonds provided for in article 6 (b) and (c) of this law shall take into account:

                    After notification of notice of payment, the debtor may object to the total debt or a section thereof within 15 days following the date of notification.

                    Continue to be implemented if the objection is not submitted on time.

                    If the debtor acknowledges the debt or a section thereof, it shall be recorded in the enforcement record, and the Service shall carry out what has been recognised.

                    If the debtor objects to the whole or part of the debt and this objection is found to be invalid before the competent court, the court shall require the debtor to impose a fine equal to one fifth of the amount of the contested debt, all of which shall be paid to the treasury, and shall persevere from the point reached.

                    In any event, if the creditor meets its debt, in whole or in part, in accordance with the procedures provided for in this article, the debtor shall still have the right to pursue substantive action to recover those that have been wrongfully satisfied.

                    In addition to paragraph (a) of this article, the execution of the bonds provided for in article 6 (b) of this law shall take into account:

                    The creditor may request the Chamber to collect its debt from the guarantor.

                    The debtor's objection to the debt shall be either by an allegation of falsification of the official document or a claim of performance in whole or in part, and the debtor shall review the competent court to establish the validity of its claim, and the transaction of execution shall cease only if the competent court has decided to suspend it to the extent that it has been challenged.

                    In addition to paragraph (a) of this article, the execution of the bonds provided for in article 6 (c) of this law shall take into account:

                    The creditor may request the Service to collect its debt from the appearances and sponsors.

                    The debtor's objection to the debt is either by denying the signature or by claiming forgery or by claiming full or partial performance.

                    In the event of denial of the signature or allegation of forgery, the transaction of execution shall cease, and the creditor shall be charged with reviewing the competent court in order to establish what the denial or allegation of forgery has occurred.

                    In the case of a claim of debt repayment in whole or in part, the debtor shall review the competent court to establish debt repayment, and the transaction of debt repayment shall cease only if the competent court has made a decision to suspend it to the extent that it has been challenged.
